Human rights and labor conditions

Non-discrimination and equal opportunities

Human rights are universal and belong to everyone equally regardless of, but not limited to: age, sex, race, color, sexual orientation, gender identity, national origin, culture, nationality, citizenship, language, religion, ideology, marital status, economic or social condition, type of occupation, degree of education, disability, pregnancy, and/or political or philosophical affiliation.

All employees shall be treated with dignity and respect. No employee shall be subject to abuse, cruel or unusual disciplinary practices, discrimination in employment, or hiring based on race, religion, origin, political affiliation, union membership, sexual preference, age, gender, or pregnancy.

Forced labor

The use of forced, bonded, prison, indentured, or compulsory labor in the production or manufacture of POPCUSTOMS products is prohibited. This includes modern forms of slavery, human trafficking, or withholding personal papers, work permits, personal identification, or compensation. It’s prohibited for factories to allow or require workers to pay employer, labor agent recruitment, or other fees for obtaining their employment. Workers shall not be subject to unreasonable restrictions of movement.

Child labor

The use of child labor is prohibited. No person shall be employed at an age that is below the applicable minimum legal age in the respective country Partners conduct their operations.

Business ethics

Compliance with sanctions, export controls, and other applicable laws

Partners will comply with the national laws of the country in which they’re conducting business, as well as local laws, regulations, or standards applicable to their business and the industry standards which have been established in their location. That includes compliance with all applicable laws, statutes, regulations, and codes relating to customs, export control, anti-boycott, and economic and financial sanctions laws and regulations, including economic and financial sanctions and trade embargoes imposed, administered, or enforced from time to time by relevant governmental authorities (“Sanctions”). Partners shall not be organized in or otherwise operate from countries or territories that are the target of Sanctions, and they shall not directly or indirectly export, re-export, or otherwise transfer any products, technology, or software furnished by POPCUSTOMS to any person, use, or location in violation of Sanctions. In the event of any conflict between the provisions of any of the preceding laws, regulations, or standards, and the provisions of this document, the provision containing the higher standards shall prevail

Environment

POPCUSTOMS always maintains a commitment to sound environmental programs and practices and encourages to reduce and recycle waste. Partners should have a precautionary action plan or an environmental management system in place to minimize the environmental impact of their operations.

Partners must comply with all applicable laws relating to the environment and dispose of hazardous and/or toxic materials in a controlled and safe manner.

Pollution prevention and resource reduction 

Waste of all types, including water and energy, are to be reduced or eliminated at the source or by practices such as modifying production, maintenance and facility processes, material substitution, conservation, recycling, and reusing materials. Partners should strive to substitute harsh and environmentally polluting chemicals with less impacting chemicals or enzymes.

Hazardous substances 

Chemicals and other materials posing a hazard, if released into the environment, shall be identified and managed to ensure their safe handling, movement, storage, recycling or reuse, and correct disposal.

Wastewater and solid waste 

Wastewater and solid waste generated from operations, industrial processes, and sanitation facilities are to be monitored, controlled, and treated as required per national law prior to discharge or disposal. Any discharge or disposal must take place with the national requirements regarding environment preservation.

Remote area issue:

It will take more time to ship to remote areas, some areas maybe need 2-3 months for delivery. We can’t provide any guarantee for remote address delivery. You can go to the shipping company’s official website to check if the address belongs to remote areas or not.

Hot-sell season:

During hot sell seasons (e.g. Black Friday, Cyber Monday, Christmas, etc.) due to the high volume of packages and limited capacity of shipping companies, shipping time may be longer than other times, and shipping costs maybe raise often. We will notify you that on our website and email it to you, pls don’t miss that information.

We will not refund if the package is shipped to the following countries:

Tax/VAT issue:

This is a seller’s responsibility as each country has different Custom Duties and Laws of Taxation.

In the event that a customer refuses to pay taxes or duties owed upon the order’s arrival in the destination country, POPCUSTOMS will not reship or refund the order.

We help sellers deal with VAT issues for EU orders. When your orders ship to the EU, our website system will automatically charge you VAT when you check out. 

If you have your own VAT/IOSS number, please add it to the order note. We will refund the VAT cost to the wallet of your account at POPCUSTOMS after order delivery. ( Since we can’t verify your VAT/IOSS, so we are not responsible for the delay or can’t delivery caused by your VAT/IOSS problem, and refund the VAT/IOSS cost till the order delivery). If you are Etsy sellers and want to use Etsy’s VAT number, please turn on this button after your order sync to POPCUSTOMS,

Please read these terms of service carefully before using Our Service.

There is Something Important you need to note before starting POPCOMMERCE SERVICE:

  1. One account is limited to set up ONE POPCOMMERCE Store.
  2. Only 50 designs can be synchronized to your POPCOMMERCE Store but you can buy our premium service to sync more.
  3. Inactivity Criteria: We will automatically close stores that have not synchronized finished products in 180 days.

Charges:

When your store has an order, we will charge 8% of Your Profit as commissions, that is “Your Profit * 8%”.

Your Profit = Total amount (paid by your customers to POPCUSTOMS) – Product’s cost – Shipping cost – Payment Processing Fee

Note: Payment processing fee ranges from 3.3% to 3.9%+0.3$

INTERPRETATION AND DEFINITIONS

POPCUSTOMS’s service (the “POPCUSTOMS Service” ) at POPCUSTOMS.com is operated by Fujian Zhongchao Technology Co., Ltd. and/or our affiliated legal entities, subsidiaries (including, but not limited to, POPCUSTOMS Development SIA), directors, contractors, licensors, officers, agents, and employees. POPCUSTOMS reserves the right to and may provide Services to you through various POPCUSTOMS legal entities depending on multiple factors, such as, but not limited to Print Provider’s location, your location, the region in which the transaction takes place and others. POPCUSTOMS Service provides merchants with the ability to create and sell custom merchandise, apparel, and other products (collectively “Merchandise” or “Products”) and buyers with the ability to find and purchase high-quality, unique Merchandise. All visitors to the POPCUSTOMS Service, Creators, and buyers are referred to herein as ”You”.

We offer the POPCUSTOMS Service subject to the following terms: Code of Conduct, Shipping Policy, Cookie Policy, Privacy Policy, Return and Refund Policy, Terms of Service, Copyright Policy, Data Handling Policy. In case of controversy or discrepancies, these Terms of Service shall prevail over POPCUSTOMS General Terms of Service. If You do not agree to POPCUSTOMS Terms, You are not authorized to use the POPCUSTOMS Service.

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

For the purposes of these Terms and Conditions definitions stipulated in the POPCUSTOMS General Terms of Service shall be applicable unless stated otherwise herein.

LISTING OF PRODUCTS ON POPCUSTOMS SERVICE

Intellectual Property Rights

By creating a listing of Products via the POPCUSTOMS Service, You represent and warrant that You own or are the licensee of all trademark rights, copyrights, rights of publicity and other intellectual property or other proprietary rights necessary to create and implement the listing (“IP Rights”), including any rights relating to the name, description, images, text or URL used for the listing. You will provide POPCUSTOMS with evidence of Your IP Rights shall it be requested by POPCUSTOMS. You and only You are liable for any third-party claims in relation to alleged violation of any third party intellectual property rights.

POPCUSTOMS will act as the seller for the Products. The determination of price, availability, accessibility, distribution, and sales terms for the Products rests solely with POPCUSTOMS. We are authorized to handle payments, managing refund inquiries, and customer support. All sales, data associated with such sales, including customer data, shall be in our sole ownership and control.

For the purpose of implementing and fulfilling Your listing and for the purpose of advertising the POPCUSTOMS Service, You hereby grant POPCUSTOMS a nonexclusive, worldwide, fully paid up, transferable, sublicensable license under Your IP Rights to copy, display, distribute, modify the content You upload to the POPCUSTOMS Service (including all related images, text, content and information).

Indemnity

To the extent any listing launched by You violates or is alleged to violate any POPCUSTOMS terms, in addition to any other remedies, You agree to indemnify and hold POPCUSTOMS harmless from any and all liabilities, losses, damages and expenses arising out of Your violation or any alleged violation of POPCUSTOMS terms and/or policies.

Listing Quality

Each listing must meet reasonable production standards. All of Your advertisements or promotional descriptions, including content that is uploaded to the POPCUSTOMS Service, must be accurate and correct and must not include any content concerning non-POPCUSTOMS activities, events, products, services or promotions.

Pricing

It is totally free for you to use our POPCOMMERCE service. However, when your store has an order, we will charge 8% of Your Profit as commissions, that is “Your Profit * 8%”.

Your Profit = Total amount (paid by your customers to POPCUSTOMS) – Product’s cost – Shipping cost – Payment Processing Fee

Note: Payment processing fee ranges from 3.3% to 3.9%+0.3$

POPCUSTOMS will only help sellers deal with VAT issues in the order. (Tax Details Check Below )

In addition, POPCUSTOMS will not charge additional fees for you.

Illicit Activities

It is forbidden to conduct any Illicit Activity against POPCUSTOMS or any third party, including when using POPCUSTOMS Service. “Illicit Activity” shall mean any intentional act or omission, including, but not limited to, deception, misrepresentation, or concealment of material facts, committed by a party with the purpose of obtaining an unjust advantage, causing harm or loss to another party, or securing money, property, services, or other benefits, or otherwise contrary to applicable laws and regulations. Illicit Activity may encompass various acts or omissions, such as:

(a) defrauding others of money or services, which involves, but is not limited to, obtaining money or services through false pretenses, manipulation, or false promises;

(b) forgery, which includes, but is not limited to, creating, altering, or using false documents, signatures, stolen or forged payment instruments or other items with the intent to deceive or defraud;

(c) fraudulent misrepresentation, which includes, but is not limited to, making false statements or omitting material facts, knowing it to be false or misleading, with the intent to induce another party to rely on such statements or omissions to their detriment;

(d) engaging in, facilitating or permitting any activity, directly or indirectly, that involves money laundering, proliferation or terrorism financing, circumvention of any sanctions applicable under national or international sanction regimes.

(e) any other acts or practices that are considered unlawful under applicable laws and regulations. POPCUSTOMS is at all times entitled to request any documents, information, or other materials reasonably necessary, including “Know Your Client” documentation, as well as conduct an interview to verify and ensure compliance of POPCUSTOMS Terms.

POPCUSTOMS is at all times entitled at its sole discretion to suspend the provision of POPCUSTOMS Service entirely or in part, as well as withhold any sums payable by POPCUSTOMS to You if it reasonably believes that you have committed an Illicit Activity or otherwise breached the POPCUSTOMS Terms.
